A petition being heard by the Supreme Court says that pharmaceutical companies that provide incentives to prescribe their medicines should be held accountable. For example, the petition cites Dolo - 650, a tablet prescribed for fever, and says its manufacturers have invested ₹ 1000 crore for free. A bench of Justices DY Chandrachud and AS Bopanna called it a "serious matter" and asked the Center to file its reply within 10 days.
Justice DY Chandrachud said, "This is not music to the ears. Even I was asked to take the same medicine when I had Covid. This is a serious matter." This petition was filed by Federation of Medical and Sales Representative Association of India.
Senior advocate Sanjay Parikh, appearing for the federation, said, "Dolo invested more than Rs 1,000 crore by giving freebies to doctors so that they would promote the drug."
The Central Board of Direct Taxes or CBDT had made the allegations after raiding 36 premises of Bengaluru-based Micro Labs Ltd in nine states. The CBDT has accused the producer of unethical behavior and said that they have detected tax evasion of Rs 300 crore.
The petition states that such practices not only lead to overuse of drugs, but can also jeopardize the health of patients; Such corruption also pushes high-priced or irrational drugs into the market.
The plea said that due to the voluntary nature of the existing rules, unethical practices by pharma companies are thriving and had even come to light during the Covid pandemic.
The plea has asked the top court to ensure that the Uniform Code of Pharmaceutical Marketing Practice is made effective by providing a monitoring mechanism, transparency and accountability.

The bench had earlier issued a notice to the Centre. Today, Additional Solicitor General KM Nataraj, appearing for the Centre, said the response is almost ready. The top court will hear the matter again on September 29.
